TERMS AND CONDITIONSJuly 30th, 2020 Welcome to Newcomers Club of New Canaan, a 501(c)(3) non-profit organization with a mailing address of PO Box 595 New Canaan, CT, USA ("NCNC” or "we" or “us”). By virtue of your membership in NCNC and the payment of membership dues you acknowledge and agree to the Terms and Conditions set forth herein. Your NCNC membership and participation in NCNC sponsored activities or events are strictly voluntary. Members should use their discretion in determining which activities and events, if any, are appropriate for them and for each member of their family. NCNC is a social club that assists new residents in becoming involved in the community and encourages social interaction among all members of the community. NCNC does not make any representation as to the quality of the character of any of its members and does not perform background checks as a condition of NCNC membership. NCNC reserves the right, at its sole discretion, to change these terms and conditions. Please check these terms and conditions periodically for changes. WAIVER OF LIABILITY ALCOHOL POLICY NCNC does not supply alcohol or reimburse members for the purchase of alcohol that may be served at small gatherings hosted by members in their homes. Members indemnify and hold NCNC and its board members harmless in connection with any and all damages that may result from the consumption of alcohol at such gatherings. NCNC may, at its sole discretion, provide alcohol at NCNC hosted events. The consumption of alcohol by members under the age of twenty-one (21) is strictly prohibited. Members are encouraged to drink responsibly and arrange for a designated driver or alternative transportation if they have been drinking alcohol. NCNC shall not be liable for damages, loss or injuries which occur, directly or indirectly, as a result of the consumption of alcohol at any such event. Each member shall indemnify and hold NCNC and its board members harmless for any and all damages, claims, or losses of any kind which result from the member’s consumption of alcohol. MEMBER WEB PORTAL AGREEMENT When using the official NCNC website, www.newcanaannewcomers.com, you acknowledge and agree that, unless otherwise provided herein or specifically indicated on said website, all materials, including images, illustrations, designs, icons, photographs, video clips, and written and other materials contained on said website, (collectively, the "Contents"), are owned and controlled by NCNC. The Contents are intended solely for noncommercial and nonprofit use. USER COMMENTS, FEEDBACK, SUBMISSIONS, AND POSTINGS NCNC has the right, but not the obligation, to monitor, screen, block, post, remove, modify, store and review Submissions or any other communications sent through this site, at any time and for any reason, including to ensure that Submissions conform to these terms, without prior notice to you. NCNC and its board members are not responsible for, and do not endorse or guarantee the opinions, views, advice or recommendations provided in any Submissions whether posted publicly or sent privately by members. Members are prohibited from making Submissions which NCNC deems, in its sole discretion, to be (i) harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, bigoted, hateful, or racially, ethnically or otherwise offensive or objectionable, (ii) violative of any law, statute, ordinance, or regulation including, but not limited to, intellectual property, consumer protection, unfair competition, anti-discrimination, or false advertising, or (iii) known to to be false, inaccurate, or misleading. REPORTING OF ABUSIVE OR UNLAWFUL SUBMISSIONS OR CONTENT LINKS TO OTHER WEBSITES AND SERVICES PHOTOGRAPHY AND VIDEOGRAPHY CHOICE OF LAW/JURISDICTION SEVERABILITY If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and shall not affect the validity and enforceability of any remaining provisions. REVISIONS NCNC reserves the right to revise these Terms and Conditions at any time for any reason. Said revisions shall take effect on the date they are published to the Terms and Conditions link provided on the NCNC website. TERMINATION NCNC reserves the right to terminate a membership if, in its sole discretion, NCNC believes the member has violated these Terms and Conditions. NCNC shall notify the member, in writing, at the address previously provided by the member. Any member’s access to the NCNC website may be terminated immediately without prior notice for failure to comply with these Terms and Conditions.
